Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of EchoTake, including its website, account features, credit purchases, media tools, and AI video generation services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service. You must be legally able to enter into this agreement in your location.
What EchoTake provides
EchoTake provides pose-guided AI motion transfer. You can select a UGC template or submit a supported, authorized public social-media link, upload a permitted portrait, choose output settings, and request a video that follows aspects of the reference motion and timing.
Generation is automated and may take time, fail, or produce results that differ from the source or your expectations. Features, supported platforms, duration limits, resolutions, providers, and credit prices may change as the Service evolves.
EchoTake applies integrated safety controls across the generation pipeline. Requests involving prohibited sexual, exploitative, deceptive, or rights-infringing content may be rejected during submission or processing, and no prohibited output will be delivered.
Accounts and access
Some features require Google Sign-In. You must provide accurate account information, protect access to your Google account and devices, and notify us if you suspect unauthorized use.
You may not sell, transfer, rent, or share access to your EchoTake account in a way that creates security, fraud, or compliance risks. You are responsible for activity conducted through your account unless prohibited by applicable law.
Your content and permissions
You retain ownership of content you submit and, as between you and EchoTake, the rights you may have in generated output. You grant EchoTake a worldwide, non-exclusive, limited license to host, copy, transmit, modify, and process your content only as needed to operate, secure, and support the Service and fulfill your requests.
You may upload only videos and images you own or are legally authorized to use. You may not upload another person's portrait, performance, or media for an unauthorized creation.
You represent and warrant that:
- you own submitted content or have all rights, licenses, notices, and permissions needed to use it with the Service;
- every identifiable person whose likeness, image, voice, or performance you submit has provided any consent required by law;
- your content and intended use do not violate privacy, publicity, copyright, trademark, contractual, or other rights; and
- your prompts and outputs will comply with these Terms and applicable law.
Acceptable use
You may not use EchoTake to:
- create deceptive impersonation, fraud, scams, fabricated endorsements, or misleading political or commercial content;
- use a person's identity, likeness, voice, or media without the rights or consent required for your use;
- create NSFW, pornographic, sexually explicit, sexually suggestive, exploitative, or non-consensual intimate content;
- create any content that sexualizes, exploits, endangers, or inappropriately depicts a minor;
- harass, threaten, defame, discriminate against, exploit, or endanger another person;
- infringe intellectual-property, privacy, publicity, or other legal rights;
- introduce malware, bypass safeguards, probe the Service, automate abusive requests, or interfere with other users;
- resell or provide access to the Service except under a separate written agreement; or
- violate applicable laws, sanctions, or platform rules.
We may review reported activity, block a request, remove content, limit access, or preserve relevant records when reasonably necessary to protect users, third parties, or the Service.
AI-generated output
AI output can be inaccurate, unexpected, or similar to content generated for others. You must review each result before using or publishing it. EchoTake does not guarantee that an output is unique, error-free, non-infringing, suitable for a particular purpose, or accepted by any social platform.
You are responsible for disclosures, labels, permissions, and human review required for your publication or commercial use of generated media. Do not represent synthetic content as authentic footage where doing so would mislead people or violate law.
Credits, payment, and refunds
EchoTake offers one-time credit purchases. These purchases do not create a subscription and do not automatically renew. Prices, included credits, bonus credits, currency, and applicable taxes are shown before checkout.
Credits are a limited, non-transferable right to request eligible Service operations. They have no cash value and cannot be sold or transferred. A generation may consume credits when a task is accepted for processing; failed tasks may be handled according to the status and refund logic presented in your account records.
Except where required by law or expressly stated at checkout, completed credit purchases and consumed credits are non-refundable. Contact us promptly if you believe a charge or credit balance is incorrect.
Third-party services
EchoTake relies on third parties for services such as Google authentication, public-link extraction, payment processing, hosting, storage, and AI generation. Their services may be subject to separate terms and may become unavailable. Submitting a social-media URL does not authorize you to disregard the source platform's terms or another person's rights.
Our service and intellectual property
EchoTake and its licensors retain all rights in the Service, including its software, interface, branding, templates, documentation, and underlying technology. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. They do not grant you rights to our trademarks or to reverse engineer, copy, or exploit the Service.
Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access, block content, or take proportionate protective action if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay, or abused the Service.
Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, limits of liability, and dispute-related provisions—will continue to apply.
Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." EchoTake disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted availability, permanent storage, specific generation results, or that the Service will meet every legal or platform requirement for your intended use. Nothing in these Terms excludes warranties that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, EchoTake will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from the Service.
To the fullest extent permitted by law, EchoTake's total liability arising out of or relating to the Service will not exceed the greater of the amount you paid to EchoTake during the six months before the event giving rise to the claim or US$100. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
Changes and contact
We may update these Terms to reflect changes to the Service, law, or risk. We will post the updated Terms and revise the effective date. Where required, we will provide additional notice. Continued use after updated Terms take effect means you accept them.
These Terms are governed by applicable law, without overriding consumer protections that apply in your country. If a dispute arises, contact us first so we can try to resolve it informally.
